Terms & Conditions of Our Services

RADSAB SERVICES provides pickup and delivery & Wash, Dry, Fold Service in the greater Washington DC Area. Rest assured; your satisfaction is our first priority. In fact, we treat your laundry as if it were our own, however you still need to agree to some rules to ensure that there are no misunderstandings about RADSAB SERVICES.

All the terms and conditions in this document are collectively referred to as “these Terms and Conditions”.

 

Definitions:

“We”, “us” and “our” mean RADSAB SERVICES LLC., t/d/b/a RADSAB SERVICES, and “You” and “your” means our customer (all regardless of whether the initial letter is capitalized). “Wash dry fold services” or “wash dry fold service” (regardless of whether any one or more initial letter is capitalized) collectively mean all services whereby we do any part or all the laundry work for a customer, including without limitation, consumer wash dry fold services and commercial laundry services. “Drop off” is shorthand for the event by which you get your laundry to us, whether it is dropped off to us or we pick it up from you or otherwise. “Clothes” and “Laundry” are general terms referring to all types of items, including without limitation clothing, linens, and specialty items.

(Please let us begin by recommending a few things for you to do, to make our service better for you:

  1. We ask that you check your pockets before bringing the laundry to us!
  2. We ask that you sort your laundry into lights and darks, and
  3. We ask you to bring your laundry to us in a bag, not in a basket.
  4. We also ask that if you have items at the end of its useful life, that you discard it rather than including them with your laundry.

Damaged/Missing Items:

We will do everything we can to avoid damaging your laundry. Unfortunately, there are limitations to what we can do. For example,  We don’t inventory or count your laundry items. Therefore, in no case are we responsible if something left in your laundry (like nail polish, chewing gum, or a pen) causes any damage. Similarly, if you call and tell us that you left your favorite ring, or anything else, in your pocket, we can’t guarantee that we will find or be able to return it. You agree not to leave those things in your laundry.

It is not possible for us to inspect every item for damage or its prior condition upon receiving it. We wash many articles of clothing that are damaged in some form or another for customers every day.

All laundering processes, regardless of how gentle, cause normal wear and tear on clothing.

As a result, we cannot be responsible for any wear and tear of laundry, including loss of buttons, fading, fatiguing, holes, or abrasions. Along the same lines, we can’t be held responsible for the re-disposition of colors (aka bleeding) or dimensional changes (aka shrinking or stretching).

Cleaning and drying laundry also creates other risks. As stated earlier, we do not individually examine every garment prior to placing it in the laundry. Therefore, if something is “dry-clean only,” or otherwise unsuitable for common washing and drying techniques, please do not include it in the laundry you give to us.

We may refuse to clean any laundry item (but if we do clean it, we’re not accepting liability that we have disclaimed).

You, the customer, therefore, agree to not hold us liable for any damages based on the condition of clothing after we deliver it back to you, as a condition of using our services. If you do not accept these terms in full, then you can cancel your order without penalty up to one hour prior to your pick-up time. After you have us pick up your laundry, you agree to accept these terms in full and agree not to hold us liable for any damages.

We still want to be sure there isn’t something we did to cause any damage so if you find something you didn’t recognize prior, we need to hear from you within 24 hrs. of delivery for us to investigate it promptly.

You agree that by using our services that if you are not home during delivery, it is OK for us to leave your order by the front door. You further agree that any loss, stolen, or damaged laundry as a result of the pick-up or delivery process is not our fault and you agree that you accept full responsibility for your laundry during these times.

 

Weight:

For any laundry that is paid by weight, the applicable weight for payment is the weight at drop off. If we are not able to weigh at drop-off, we have the right to charge based on our estimate of weight based on weight at pickup or otherwise.

 

Stain Removal:

We do NOT offer stain removal services; however,  we will use “reasonable efforts” to clean your laundry well. We do offer a “Color Safe” bleach alternative that is made for tough stains, and we can add that if requested into your order.

Many common stains do come out during our normal washing; however, we make no claims or guarantees that we will be able to remove any of them as we only provide basic washing and drying services.

 

Reasonable Efforts:

We really care about your clothes, but you know that in rare instances things get lost or damaged even when Mom does the wash! So, we are not responsible for missing, damaged, discolored, or shrunk items, or for color bleeding.

If something like this happens, we will always try to work with you, because we care. To increase the likelihood of satisfaction if you do have a problem, all claims must be made within 24 hours after receiving your clothing. Ultimately, however, if something is lost or damaged in any way (regardless of type or cost) we do not accept legal liability.

 

Special Requests: 

Our wash dry fold services include your choice of (a) hypoallergenic or scented laundry products, and (b) dress clothes hung or folded.  We are sorry, but we do not accept any other special requests unless agreed upon by us as set forth in the “No Changes” paragraph below.

 

*Allergies:

We offer and use “All Free and Clear” detergent for customers with sensitive skin. However, we do wash clothes in shared washing machines where other detergents may have been used, and it is possible that small amounts of other detergents, which may not be hypoallergenic, may not be completely rinsed out of these washing machines.

 

Pricing:

While we are conscientious of the importance of price stability, we reserve the right to increase or otherwise change the price(s) of our Wash Dry Fold services at any time. No advance notice is required for increases or other changes in our price(s).

 

 Warranties & Limitation of Liability: 

WE HAVE NOT MADE ANY (AND WE MAKE NO) REPRESENTATIONS OR WARRANTIES, DIRECT OR INDIRECT, EXPRESS, OR IMPLIED, AS TO ANY MATTER WHATSOEVER. IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY DAMAGES RELATED TO THESE TERMS AND CONDITIONS OR ANY SERVICE PROVIDED TO YOU OR NOT PROVIDED TO YOU. THIS LIMITATION OF LIABILITY SHALL APPLY WHETHER ANY CLAIM IS BASED UPON BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, PRINCIPLES OF INDEMNITY OR CONTRIBUTION, THE FAILURE OF ANY LIMITED OR EXCLUSIVE REMEDY TO ACHIEVE ITS ESSENTIAL PURPOSE OR OTHERWISE.

 

Venue and Choice of Law:

The relationship between you and us is governed by and shall be construed in accordance with the law of the Commonwealth of Maryland without regard to its conflicts of law provisions. You and we consent and agree that any legal proceedings related to our relationship shall be brought and maintained in a court of competent jurisdiction located in or with express federal jurisdiction over Montgomery County, Maryland, and you and we agree that jurisdiction and venue for any such proceedings shall rely exclusively within the courts of the Commonwealth of Maryland, or the United States District Court for the Eastern or Middle District of the Commonwealth of Maryland.

 

Attorney’s Fees:

You agree that if we are sued pertaining to (a) any item(s) that is(are) missing, damage, discolored, shrunk or color bled, (b) item(s) that you or someone else claims you did not own or have the right to deliver to us, (c) Our termination of wash dry fold services to You for any reason or no reason, or (d) related to Our increasing the price of wash dry fold services, then to the extent permitted by law you will reimburse us for the cost of our reasonable attorney’s fees. Furthermore, if we consult an attorney or collection agency for the collection of any sums due from You, You, whether proceedings are instituted, shall reimburse Us for the reasonable fees for legal counsel and court costs, if any, incurred by Us.

 

Paragraph Headings:

The paragraph headings are only for convenience and shall not be deemed to limit or define the contents of the paragraph.

 

Severability:

If any provision of these Terms and Conditions or the application thereof to any person or circumstance is held invalid or unenforceable to any extent, the remainder of these Terms and Conditions and the application of that provision to other persons or circumstances is not affected thereby and that provision shall be enforced to the greatest extent permitted by law.

No Changes: No employee or agent of Festiva Laundry is authorized to change anything in these Terms and Conditions, except in an express written agreement signed by the President or Vice President of Festiva Lancaster, Inc. Any other attempted or purported change shall not be binding on Us.  For example, but without limitation, you cannot impose your own terms and conditions upon Us by any means including without limitation by purported email confirmations. Additional limitations on changes or additions to these Terms and Conditions are set forth below.

 

Entire Agreement:

These Terms and Conditions constitute the entire agreement between the Parties with respect to this subject matter and supersedes all previous or contemporaneous statements, representations, understandings, negotiations, discussions, and writings between the Parties with respect to this subject matter and cannot be modified except by a written instrument signed by the Parties.

Wash, Dry, Fold Service: These Wash, Dry, Fold Terms and Conditions apply to all Wash Dry Fold services (including without limitation consumer and commercial account services). The General Terms and Conditions set forth above also apply. We care about your laundry and are happy to provide wash dry fold services to you!

 

These Terms and Conditions control our services:

We offer you our wash dry fold services subject to your compliance with and acceptance of these Terms and Conditions. Your use of the wash dry fold services indicates your agreement to be bound by the Terms and Conditions contained herein and the General Terms and Conditions. Please read them carefully and if you do not agree, please do not use our services. These Terms and Conditions are subject to change by us without notice at any time, at our sole discretion. You cannot impose your own terms and conditions upon Us by any means including without limitation by purported email confirmations, and under no circumstances will We be bound by any terms and conditions in addition to or contrary to these Terms and Conditions unless We have expressly agreed to the contrary in written document that is actually signed by the President or Vice President of RADSAB SERVICES, LLC.

 

Permission to Communicate:

You recognize that we are entering into a business relationship. You hereby consents to us phoning, faxing, e-mailing, texting and using social media (whether or not any such number, address or media is solely yours or belongs in whole or part to a third party) to communicate with you about: (a) pick-up and delivery, (b) marketing and/or other business-related communications (including automated calls or texts) and (c) any and all other purposes related to our business relationship or permitted by law. You agree and understand that with texting, standard message and data rates may apply.

 

Termination of Service: 

While we love our customers and hope all our business relationships last forever, we reserve the right to terminate our business relationship with, and our services to, you at any time and for any reason or no reason.  We will give reasonable notice of termination, if the circumstances permit, but we are not obligated to give you such notice.  If we have your clothing in our possession at the time of termination, we will make reasonable attempts to return it to you or permit you to pick it up from us.

 

Pick-up and Delivery: 

RADSAB SERVICES provides pick-up and delivery service in the greater Washington DC Area. We will do our best to pick up your laundry at the agreed upon time, however sometimes things beyond our control (think Highway 4 traffic) can cause delays. We don’t want to be late, however we can’t be held accountable if we are late for unforeseen circumstances. Similarly, we hope that you will strive to be on time for our pick-ups and deliveries. If you do miss a pick-up or delivery, we will try to coordinate an alternate time as soon as possible.

If we agree to provide pick-up and/or delivery, you agree to provide us with parking and access to your location which is nearby, convenient, prompt, and free. We try to be flexible, but reserve the right if we deem it prudent, to charge extra for inconvenience and/or to require you to deliver/pickup at RADSAB SERVICES.

Without limiting the generality of the previous sentence, in the event we are ticketed in our attempt to park in a convenient nearby space, you agree to reimburse us for the ticket costs as additional payment for wash dry fold services.

Any pricing we quote you is subject to adjustment for things like small orders, one-way trips, specialty items, etc.  As with all pricing, pick-up and delivery charges are subject to change without notice.

A No Show is when we show up to your door, but you and your laundry aren’t around. In the case of a Now Show, we reserve the right to charge a No-Show fee. Keep in mind, there’s no fee if you cancel or reschedule 4 hours before the start of your pick-up or delivery time.

 

Unattended Pick-up and Delivery:

If you request that we leave your laundry unattended (e.g., on your porch, in a hallway, or in your foyer) or with a third party (e.g., with a doorman or a neighbor), we are not responsible for your laundry before we have picked it up or after we have dropped it off. You also agree that our records of pick-up and drop-off times are true and accurate.

 

Payment:

Payment for wash dry fold services is requested at drop off. Unless other arrangements have been agreed upon in writing, payment must always be made before your laundry is returned to you. If we invoice you, you agree to pay late fees and interest on unpaid balances at rates and amounts set forth from time to time in invoices and statements, together with attorney’s fees as set forth above.  You agree we may charge a convenience fee for credit card payments.

 

Ownership of Your Laundry:

You agree that the only laundry you will ever drop off to us will be items you own or are authorized to drop off to us.

 

Assignment:

You may not assign your rights under these Terms and Conditions, or at law or equity, to any other person or entity.
